By checking the applicable box or by registering for or attending an event sponsored by Ellavation, you agree to the following, and this release and waiver applies to you and any person who enters, attends, or participates in the Event with you (“You”).

By entering or participating in the Event, You agree as follows. You acknowledge that photography, audio recording, video recording, live streaming, and similar capture activities will occur at the Event. You grant to Ellavation and its current and future affiliates, licensees, assignees, sponsors, media partners, grantees, and designees the perpetual, worldwide, royalty-free, irrevocable right and license to record, use, reproduce, adapt, modify, edit, combine with other content, publish, translate, publicly perform, publicly display, distribute, and otherwise exploit, in whole or in part, Your name, image, voice, likeness, biographical information, and statements as captured at or in connection with the Event (collectively, “Likeness”), in all forms and media now known or hereafter devised, for any lawful purpose consistent with Ellavation’s nonprofit mission, including without limitation educational, promotional, marketing, fundraising, development, archival, and reporting purposes.

You understand and agree that: Ellavation is not required to use Your Likeness; You will receive no compensation, consideration, or notice for any uses; You waive any right to inspect or approve the Recordings or materials incorporating the Recordings; and Ellavation may edit, adapt, or create derivative works from the Recordings in its discretion. You further agree that no use of Your Likeness will constitute an endorsement by You of any product, service, or viewpoint, and Ellavation will not knowingly present Your Likeness in a manner that falsely suggests such endorsement.

To the maximum extent permitted by applicable law, You release, discharge, and hold harmless Ellavation and its officers, directors, employees, volunteers, agents, contractors, sponsors, partners, licensees, assignees, media outlets, successors, and affiliates (together, the “Released Parties”) from any and all claims, demands, causes of action, damages, liabilities, costs, and expenses of any kind, whether known or unknown, arising out of or related to the capture, use, or publication of the Recordings or Your Likeness, including without limitation claims for infringement, defamation, false light, invasion of privacy, violation of publicity rights, or moral rights. Where applicable, You waive the benefits of any statute or rule that might otherwise limit the scope of this Release.

If You are a parent or legal guardian of a minor attending or participating in the Event, You represent and warrant that You have the authority to agree to this Release on behalf of the minor and You do so. You agree to indemnify and hold harmless the Released Parties from and against any claims arising from the minor’s attendance or Your lack of authority to bind the minor.

You acknowledge that Ellavation may process personal information contained in the Recordings for the purposes described above and consistent with applicable law. This Release constitutes the entire understanding with respect to the subject matter and supersedes any prior or contemporaneous communications on that subject. If any provision is held invalid, the remainder will continue in full force and effect. This Release will be governed by the laws of Illinois, without regard to its conflicts rules, and any disputes will be brought exclusively in the state or federal courts located in Cook County, Illinois, and You consent to personal jurisdiction there.

By entering or participating in the Event, You acknowledge that You have read, understood, and agree to be bound by this Release.
